Navigating the Ethical Boundaries of Grateful Patient Fundraising

There is limited literature examining the ethical issues that grateful patient fundraising raises for physicians. The last American Medical Association report on this topic was issued in 2004.4 The report recognized the value of philanthropy and physicians’ role in it, but rightly emphasized the paramount importance of patients’ rights and welfare in efforts directed at grateful patient fundraising. As such, the report highlighted the need to ensure that gifts are voluntary, that patients should not perceive an obligation to give, and the need to protect privacy. In addition, the report cautioned against physicians initiating discussions about philanthropy during direct patient care. Furthermore, there is also limited literature about the ethical issues grateful patient fundraising poses for development professionals and the health care institutions they represent. Grappling with the ethical issues in grateful patient fundraising necessitates considering them from all of these perspectives.

Among the key issues were challenges related to clinicians having discussions about philanthropy with patients who might be especially vulnerable due to their diseases or conditions, the tensions related to conflicts in regard to clinicians’ primary obligations to patient care and a competing obligation to fundraising, the potential effects of fundraising on patient care, possible unintended consequences of concierge services provided to donors, and concerns about privacy.5 The recommendations for clinicians include those concerning when grateful patient fundraising is appropriate (eg, ideally separate from the clinical encounter, not in situations of heightened vulnerability), minimizing conflicts of obligation and commitment, and respecting the donor’s intent of a gift. The recommendations for fundraising professionals and institutions include the need for transparency in relationships, not interfering with clinical care, attending to confidentiality and privacy, appropriateness of concierge services, and institutional policies and training in grateful patient fundraising.

A Plutocratic Proposal: an ethical way for rich patients to pay for a place on a clinical trial

Abstract

Many potential therapeutic agents are discarded before they are tested in humans. These are not quack medications. They are drugs and other interventions that have been developed by responsible scientists in respectable companies or universities and are often backed up by publications in peer-reviewed journals. These possible treatments might ease suffering and prolong the lives of innumerable patients, yet they have been put aside. In this paper, we outline a novel mechanism—the Plutocratic Proposal—to revive such neglected research and fund early phase clinical trials. The central idea of the Proposal is that any patient who rescues a potential therapeutic agent from neglect by funding early phase clinical trials (either entirely or in large part) should be offered a place on the trial.

The ethical argument against philanthropy

Exceptionally wealthy people aren’t a likeable demographic, but they have an easy way to boost personal appeal: Become an exceptionally wealthy philanthropist. When the rich use their money to support a good cause, we’re compelled to compliment their generosity and praise their selfless work.

This is entirely the wrong response, according to Rob Reich, director of the Center for Ethics in Society at Stanford University.

Big philanthropy is, he says, “the odd encouragement of a plutocratic voice in a democratic society.” By offering philanthropists nothing but gratitude, we allow a huge amount of power to go unchecked. “Philanthropy, if you define it as the deployment of private wealth for some public influence, is an exercise of power. In a democratic society, power deserves scrutiny,” he adds.

A philanthropic foundation is a form of unaccountable power quite unlike any other organization in society. Government is at least somewhat beholden to voters, and private companies must contend with marketplace competition and the demands of shareholders.

But until the day that government services alleviate all human need, perhaps we should be willing to overlook the power dynamics of philanthropy—after all, surely charity in unchecked form is better than nothing?

The Logic of Effective Altruism

Effective altruism is based on a very simple idea: we should do the most good we can. Obeying the usual rules about not stealing, cheating, hurting, and killing is not enough, or at least not enough for those of us who have the good fortune to live in material comfort, who can feed, house, and clothe ourselves and our families and still have money or time to spare. Living a minimally acceptable ethical life involves using a substantial part of our spare resources to make the world a better place. Living a fully ethical life involves doing the most good we can.

Most effective altruists are millennials—members of the first generation to have come of age in the new millennium. They are pragmatic realists, not saints, so very few claim to live a fully ethical life. Most of them are somewhere on the continuum between a minimally acceptable ethical life and a fully ethical life. That doesn’t mean they go about feeling guilty because they are not morally perfect. Effective altruists don’t see a lot of point in feeling guilty. They prefer to focus on the good they are doing. Some of them are content to know they are doing something significant to make the world a better place. Many of them like to challenge themselves to do a little better this year than last year.

Absent from his narrative, though, was the back story, one that underscores a profound change taking place in the way science is paid for and practiced in America. In fact, the government initiative grew out of richly financed private research: A decade before, Paul G. Allen, a co-founder of Microsoft, had set up a brain science institute in Seattle, to which he donated $500 million, and Fred Kavli, a technology and real estate billionaire, had then established brain institutes at Yale, Columbia and the University of California. Scientists from those philanthropies, in turn, had helped devise the Obama administration’s plan.

American science, long a source of national power and pride, is increasingly becoming a private enterprise.
