Ethics experts say Trump administration far from normal

President Donald Trump’s young administration has already sharply diverged from the ethical norms that typically govern the executive branch, exposing vulnerabilities in the system, a small group of ethics experts and former government officials agreed Saturday.

The consensus emerged at a panel titled “Trump, Ethics and the Law” at the Texas Tribune Festival in Austin, Texas. The panel was moderated by Dave Levinthal, a senior reporter at the Center for Public Integrity.

“There have been untidy administrations in the past, but usually it takes a while to see these things develop,” said Ken Starr, a lawyer and judge who served as solicitor general under President George H.W. Bush and is best known for heading the investigation that led to the impeachment of President Bill Clinton.

Ethics laws are based on the idea that norms will be followed, said Walter Shaub, former director of the U.S. Office of Government Ethics (OGE).

“When they’re not followed, we suddenly discover how completely vulnerable our system is,” Shaub said.

Jared and Ivanka are failing a basic moral test

But the silence emanating from Jared and Ivanka was exponentially more powerful than any I'd heard before. To me, as a Jew, seeing nothing but two tweets from Ivanka brought the kind of pain I'm sure is echoed by African-Americans anytime Ben Carson defends the President, and Asian-Americans in the wake of Elaine Chao's and Nikki Haley's equivocations: condemning hate in general terms while carefully avoiding criticizing the very administration they're part of.

No press conference was forthcoming, no rejection of Donald Trump's words; there was no statement from Jared about the horror his grandparents had survived; nothing from Ivanka, who had spoken about standing up for mothers on the campaign trail, about defending today's Jewish children -- her children; indeed all children -- from intimidation and violence. There was nothing, but the sound of steady clicking on Ivanka's electronic device as she wrote two tweets.

It was like listening to the fabric of Judaism tear at itself.

Beneath Jewish rituals, customs and rules lies a simple and sacred idea: preserving the sanctity of life. It's why the ill are absolved from fasting on days of penance. It's why the no-electricity, no-work rules of Shabbat go out the window the moment a life-threatening emergency hits. In fact, it's considered a grave sin to put someone at risk by blindly keeping the Sabbath, for it places righteousness above humanity. This ethical focus on preserving life is the substrate of Judaism, first, last and always.

Donald Trump has a very clear attitude about morality: He doesn't believe in it

The more President Donald Trump reveals his character, the more he isolates himself from the American mainstream.

In a raucous press conference this afternoon, the president again blamed "both sides" for deadly violence in Charlottesville. He equated "Unite the Right" protesters — a collection including white supremacists, neo-Nazis and ex-KKK leader David Duke — with protesters who showed up to counter them.

Earlier he targeted business leaders — specifically, executives from Merck, Under Armour, Intel, and the Alliance for American Manufacturing — who had quit a White House advisory panel over Trump's message. In a tweet, the president called them "grandstanders."

That brought two related conclusions into focus. The president does not share the instinctive moral revulsion most Americans feel toward white supremacists and neo-Nazis. And he feels contempt for those — like the executives — who are motivated to express that revulsion at his expense.

No belief in others' morality

Trump has displayed this character trait repeatedly. It combines indifference to conventional notions of morality or propriety with disbelief that others would be motivated by them.

He dismissed suggestions that it was inappropriate for his son and campaign manager to have met with Russians offering dirt on Hillary Clinton during the presidential campaign. "Most people would have taken the meeting," he said. "Politics isn't the nicest business."

The ethical argument against philanthropy

Exceptionally wealthy people aren’t a likeable demographic, but they have an easy way to boost personal appeal: Become an exceptionally wealthy philanthropist. When the rich use their money to support a good cause, we’re compelled to compliment their generosity and praise their selfless work.

This is entirely the wrong response, according to Rob Reich, director of the Center for Ethics in Society at Stanford University.

Big philanthropy is, he says, “the odd encouragement of a plutocratic voice in a democratic society.” By offering philanthropists nothing but gratitude, we allow a huge amount of power to go unchecked. “Philanthropy, if you define it as the deployment of private wealth for some public influence, is an exercise of power. In a democratic society, power deserves scrutiny,” he adds.

A philanthropic foundation is a form of unaccountable power quite unlike any other organization in society. Government is at least somewhat beholden to voters, and private companies must contend with marketplace competition and the demands of shareholders.

But until the day that government services alleviate all human need, perhaps we should be willing to overlook the power dynamics of philanthropy—after all, surely charity in unchecked form is better than nothing?

Trump Exempts Entire Senior Staff From White House Ethics Rules

Andrew Olmem, another White House economist and a former lobbyist for a host of large financial services and insurance firms, will be free to work with former clients on specific issues affecting bank capital requirements, financial regulation of insurers, and the Puerto Rican debt crisis, all issues on which he has recently lobbied.

Those officials have been given freer rein to advance their former clients’ financial interests, but ethics rules have also been waived for every other “commissioned officer”—staffers who report directly to the president—in the White House who has worked for a political group in the past two years.

That will allow a number of White House staffers to collaborate with pro-Trump advocacy operations. The West Wing is stacked with officials who have made significant sums working, consulting for, or representing high-profile political organizations, including networks of groups financed by the Trump-backing Mercer family and the libertarian Koch family.

Conway herself consulted for more than 50 political, policy, and advocacy organizations last year, according to a White House financial disclosure statement.

Foucault’s work shows that disciplinary power was just one of many forms that power has come to take over the past few hundred years. Disciplinary anatomo-politics persists alongside sovereign power as well as the power of bio-politics. In his next book, The History of Sexuality, Foucault argued that bio-politics helps us to understand how garish sexual exuberance persists in a culture that regularly tells itself that its true sexuality is being repressed. Bio-power does not forbid sexuality, but rather regulates it in the maximal interests of very particular conceptions of reproduction, family and health. It was a bio-power wielded by psychiatrists and doctors that, in the 19th century, turned homosexuality into a ‘perversion’ because of its failure to focus sexual activity around the healthy reproductive family. It would have been unlikely, if not impossible, to achieve this by sovereign acts of direct physical coercion. Much more effective were the armies of medical men who helped to straighten out their patients for their own supposed self-interest.

Other forms of power also persist in our midst. Some regard the power of data – that is the info-power of social media, data analytics and ceaseless algorithmic assessment – as the most significant kind of power that has emerged since Foucault’s death in 1984.

Investigating Altruism and Selfishness Through the Hypothetical Use of Superpowers

Abstract

Drawing from literature associating superheroes with altruism, this study examined whether ordinary individuals engaged in altruistic or selfish behavior when they were hypothetically given superpowers. Participants were presented with six superpowers—three positive (healing, invulnerability, and flight) and three negative (fear inducement, psychic persuasion, and poison generation). They indicated their desirability for each power, what they would use it for (social benefit, personal gain, social harm), and listed examples of such uses. Quantitative analyses (n = 285) revealed that 94% of participants wished to possess a superpower, and majority indicated using powers for benefiting themselves than for altruistic purposes. Furthermore, while men wanted positive and negative powers more, women were more likely than men to use such powers for personal and social gain. Qualitative analyses of the uses of the powers (n = 524) resulted in 16 themes of altruistic and selfish behavior. Results were analyzed within Pearce and Amato’s model of helping behavior, which was used to classify altruistic behavior, and adapted to classify selfish behavior. In contrast to how superheroes behave, both sets of analyses revealed that participants would hypothetically use superpowers for selfish rather than altruistic purposes. Limitations and suggestions for future research are outlined.

Government Ethics Office Website Crashes Under Too Much Traffic — Again

The Office of Government Ethics is back in the news as its website crashed, for the second time in less than a month, again under a flood of inquiries.

The advisory agency typically works to vet people who run the country and detangle them from financial ties that may influence their work in public office. And typically, this work happens quietly in the background when administrations transition from one president to another.

But the OGE has received an extraordinary amount of spotlight as Donald Trump has become president. OGE chief has been one of the loudest critics of Trump's decision to remain the owner of his worldwide business empire, with its vast web of financial interests.

On Thursday, the OGE's website was overwhelmed by a surge of clicks.

"OGE's website, phone system and email system are receiving an extraordinary volume of contacts from citizens about recent events," the agency said on Twitter.

How Well Does Your State Protect Patients?

In most states, doctors dominate medical licensing boards and have the authority to decide who is fit to practice medicine and who isn’t. Usually the laws do not restrict a board’s authority by mandating certain punishments for some types of violations. Many licensing boards — including Georgia’s — say that’s how it should be.

“Having a bold, bright line saying a felony equals this or that is not good policy,” said Bob Jeffery, executive director of the Georgia Composite Medical Board.

Jeffery said criminal courts punish offenders and civil courts can compensate victims. Medical regulators, he said, have a different role.

“A licensing board is charged with making sure a (doctor) is safe to practice and that patients are protected,” he said.

With no legal prohibition standing in the way in most states, doctor-dominated medical boards often decide that doctors busted for abusive or illegal behaviors can be rehabilitated and safely returned to exam rooms.

New Jersey licensed a doctor convicted of sexual offenses with four patients. Kansas licensed a doctor imprisoned in Ohio for a sexual offense involving a child; that doctor later lost his Kansas license after making anonymous obscene phone calls to patients. Utah licensed a doctor who didn’t contest misdemeanor charges of sexual battery for intentionally touching the genitals of patients, staff members and others.

Structural racism, the systems-level factors related to, yet distinct from, interpersonal racism, leads to increased rates of premature death and reduced levels of overall health and well-being. Like other epidemics, structural racism is causing widespread suffering, not only for black people and other communities of color but for our society as a whole. It is a threat to the physical, emotional, and social well-being of every person in a society that allocates privilege on the basis of race.  We believe that as clinicians and researchers, we wield power, privilege, and responsibility for dismantling structural racism — and we have a few recommendations for clinicians and researchers who wish to do so.

First, learn about, understand, and accept the United States’ racist roots. Structural racism is born of a doctrine of white supremacy that was developed to justify mass oppression involving economic and political exploitation.3 In the United States, such oppression was carried out through centuries of slavery premised on the social construct of race.

Our historical notions about race have shaped our scientific research and clinical practice. For example, experimentation on black communities and the segregation of care on the basis of race are deeply embedded in the U.S. health care system.

How should professors found responsible for sexual harassment be punished? How can colleges encourage victims -- often graduate students who work closely with their harassers -- to come forward? On Tuesday a panel featuring two scholars, a member of Congress, a university official, and a journalist tackled those questions and others about harassment in the sciences and in academe more broadly.

The panel, which took place at the University of California at San Francisco and was broadcast on Facebook Live, was hosted by Rep. Jackie Speier, Democrat of California, who in January drew attention for taking a stand against sexual harassment in the sciences, in a speech on the floor of the U.S. House of Representatives.

Should we be afraid of AI?

We should make AI environment-friendly. We need the smartest technologies we can build to tackle the concrete evils oppressing humanity and our planet, from environmental disasters to financial crises, from crime, terrorism and war, to famine, poverty, ignorance, inequality and appalling living standards.

We should make AI human-friendly. It should be used to treat people always as ends, never as mere means, to paraphrase Immanuel Kant.

We should make AI’s stupidity work for human intelligence. Millions of jobs will be disrupted, eliminated and created; the benefits of this should be shared by all, and the costs borne by society.

We should make AI’s predictive power work for freedom and autonomy. Marketing products, influencing behaviours, nudging people or fighting crime and terrorism should never undermine human dignity.

And finally, we should make AI make us more human. The serious risk is that we might misuse our smart technologies, to the detriment of most of humanity and the whole planet. Winston Churchill said that ‘we shape our buildings and afterwards our buildings shape us’. This applies to the infosphere and its smart technologies as well.

White Coat

Others wonder if the white coat is out of step in a culture of informality, and should be abandoned like the wigs of court dress in the United Kingdom—a topic of ongoing contention. Symbols of power and authority make people nervous, causing their blood pressure to rise (“white coat syndrome”) and their thoughts to shut down. Doctors seek compliance and trust. Today, they are taught to read emotional signals and are given empathy training. They no longer want to be intimidating authorities issuing orders, but providers offering services to clients. Fittingly, some are now wearing business attire.

But if some doctors are shedding the white coat, people in other professions are eager to put them on. They are showing up on different sorts of body experts, those found at cosmetic counters, spas, and salons, who are eager to align themselves with symbols of power and authority, and with the aura of objectivity, truth, and service.

Harvard Tells Profs Not to Sleep With Undergrads

Harvard University banned professors from having “sexual or romantic relationships” with undergraduates, joining a list of campuses that have taken similar steps.

Many colleges discourage but don’t ban sex between professors and students. While a national professors’ group doesn’t favor such a prohibition, recent moves by Harvard, Yale University and the University of Connecticut suggest the tide may be turning.

Scale of medical decisions shifts to offer varied balances of power

Patients never used to worry about making healthcare decisions. They didn't have to. Their doctors made just about all of their decisions for them. Everyone simply assumed that doctors knew what was best.

But that paternalistic view of doctors as know-it-alls has gone by the board, says Dr. Clarence Braddock, vice dean for education at the David Geffen School of Medicine at UCLA. "Now doctors are seen as the experts on medical information and choices," he explains, "but patients are seen as the experts on what those choices mean in their own lives."

The upshot? Doctors still make decisions sometimes, but sometimes patients make them, and sometimes doctors and patients make them together.

Lawrence Lessig’s March to End Corruption

This week, we bring you a special report on a two-week, 185-mile trek through the winter cold in New Hampshire, led in January by constitutional scholar and activist Lawrence Lessig to raise awareness of the crippling problem of corruption in American politics.

“If you think about every single important issue America has to address — if you’re on the right and you care about tax reform or addressing the issues of the deficit, or on the left and you care about climate change or real health care reform — whatever the issue is, if you look at the way our system functions right now you have to see that there will be no sensible reform given the way we fund campaigns,” Lessig says.
