Should non-disclosures be considered as morally equivalent to lies within the doctor–patient relationship?

Abstract

In modern practice, doctors who outright lie to their patients are often condemned, yet those who employ non-lying deceptions tend to be judged less critically. Some areas of non-disclosure have recently been challenged: not telling patients about resuscitation decisions; inadequately informing patients about risks of alternative procedures and withholding information about medical errors. Despite this, there remain many areas of clinical practice where non-disclosures of information are accepted, where lies about such information would not be. Using illustrative hypothetical situations, all based on common clinical practice, we explore the extent to which we should consider other deceptive practices in medicine to be morally equivalent to lying. We suggest that there is no significant moral difference between lying to a patient and intentionally withholding relevant information: non-disclosures could be subjected to Bok's ‘Test of Publicity’ to assess permissibility in the same way that lies are. The moral equivalence of lying and relevant non-disclosure is particularly compelling when the agent's motivations, and the consequences of the actions (from the patient's perspectives), are the same. We conclude that it is arbitrary to claim that there is anything inherently worse about lying to a patient to mislead them than intentionally deceiving them using other methods, such as euphemism or non-disclosure. We should question our intuition that non-lying deceptive practices in clinical practice are more permissible and should thus subject non-disclosures to the same scrutiny we afford to lies.

I’ve just finished watching it and it’s something of a masterpiece of psychological storytelling, delving deep into contemporary tales of dishonesty, and supporting its narrative with cunningly designed experiments that have been neatly reconstructed for the film camera.

'We Didn't Lie,' Volkswagen CEO Says Of Emissions Scandal

NPR: You said this was a technical problem, but the American people feel this is not a technical problem, this is an ethical problem that's deep inside the company. How do you change that perception in the U.S.?

Matthias Mueller: Frankly spoken, it was a technical problem. We made a default, we had a ... not the right interpretation of the American law. And we had some targets for our technical engineers, and they solved this problem and reached targets with some software solutions which haven't been compatible to the American law. That is the thing. And the other question you mentioned — it was an ethical problem? I cannot understand why you say that.

NPR: Because Volkswagen, in the U.S., intentionally lied to EPA regulators when they asked them about the problem before it came to light.

Mueller: We didn't lie. We didn't understand the question first. And then we worked since 2014 to solve the problem. And we did it together and it was a default of VW that it needed such a long time.

Researchers uncover patterns in how scientists lie about their data

Even the best poker players have "tells" that give away when they're bluffing with a weak hand. Scientists who commit fraud have similar, but even more subtle, tells, and a pair of Stanford researchers have cracked the writing patterns of scientists who attempt to pass along falsified data.

The work, published in the Journal of Language and Social Psychology, could eventually help scientists identify falsified research before it is published.

There is a fair amount of research dedicated to understanding the ways liars lie. Studies have shown that liars generally tend to express more negative emotion terms and use fewer first-person pronouns. Fraudulent financial reports typically display higher levels of linguistic obfuscation – phrasing that is meant to distract from or conceal the fake data – than accurate reports.

Volkswagen and the Future of Honesty

Then came the revelations that Volkswagen installed software on 11 million diesel cars that reduced emissions of nitrogen oxides only when the cars were undergoing emissions tests, enabling them to pass, even though in normal use their emissions levels greatly exceeded permitted levels. In the wake of the ensuing scandal, the New York Times invited experts to comment on whether “the pervasiveness of cheating” has made moral behavior passé. The newspaper published their responses under the heading: “Is Honesty for Suckers?”

Cynics would say that nothing has changed in the last 40 years, and nothing will change, because in business, all talk of ethics is intended only to camouflage the ultimate aim: profit maximization. Yet Volkswagen’s cheating is odd, because, even – or especially – by the standard of profit maximization, it was an extraordinarily reckless gamble. Anyone at Volkswagen who knew what the software was doing should have been able to predict the company was likely to lose.

How to get kids to tell the truth? It's not all about carrot or stick

All parents have to come to terms with the fact that their little angels will, from time to time, act like little devils. They’ll throw tantrums over trivial issues, or they’ll push, hit, bite or scratch other kids. And at some point they’ll start lying about what they’ve done.

Lying is perfectly normal among children, not a sign of a sociopath in the making. Many kids start telling the odd fib around their second birthday, and by the time they’re 4 or 5 they’re even better at the art of manipulating the truth, and keeping it from us. So how can parents help their kids internalise the lesson that honesty is the best — or at least the socially preferred — policy?

The effects of punishment and appeals for honesty on children’s truth-telling behavior

Abstract

This study examined the effectiveness of two types of verbal appeals (external and internal motivators) and expected punishment in 372 children’s (4- to 8-year-olds) truth-telling behavior about a transgression. External appeals to tell the truth emphasized social approval by stating that the experimenter would be happy if the children told the truth. Internal appeals to tell the truth emphasized internal standards of behavior by stating that the children would be happy with themselves if they told the truth. Results indicate that with age children are more likely to lie and maintain their lie during follow-up questioning. Overall, children in the External Appeal conditions told the truth significantly more compared with children in the No Appeal conditions. Children who heard internal appeals with no expected punishment were significantly less likely to lie compared with children who heard internal appeals when there was expected punishment. The results have important implications regarding the impact of socialization on children’s honesty and promoting children’s veracity in applied situations where children’s honesty is critical.

What's the price on your integrity? Tell the truth; everyone has a tipping point. We all want to be honest, but at some point, we'll lie if the benefit is great enough. Now, scientists have confirmed the area of the brain in which we make that decision, using advanced imaging techniques to study how the brain makes choices about honesty.

The study sheds light on the neuroscientific basis and broader nature of honesty. Moral philosophers and cognitive psychologists have had longstanding, contrasting hypotheses about the mechanisms governing the tradeoff between honesty and self-interest.

The "Grace" hypothesis, suggests that people are innately honest and have to control honest impulses if they want to profit. The "Will" hypothesis holds that self-interest is our automatic response.

When Lauren told NPR that she was the first to suggest that scientists look in rivers for evidence of lionfish, she was not being honest. Worst-case scenario, she knowingly told a lie, but even if she simply misspoke, she made a mistake. That’s what children do, and when they do, the adults in their lives are tasked with turning those mistakes into learning experiences. One can only hope that in a private conversation after that NPR interview, Lauren’s father had pointed out that, actually, the original idea for her “finding” had come from another scientist, one he’d known professionally, and that maybe they should mention Jud’s work in her next interview. However, as Lauren went on to perpetuate falsehoods in subsequent interviews, the adults in Lauren’s life seem to have fallen down on their job as teachers and role models.

Parole board psychologist admits he made up story

Frank Colistro had told KOIN 6 News he was shot during two different hostage negotiation operations

Frank Colistro, an influential Portland psychologist, told KOIN 6 News he was shot twice in the line of duty.

He now admits that was a lie.

Colistro is one of only five psychologists the Oregon Parole Board uses to evaluate inmates to help determine if they’re ready to be released from prison. He’s weighed in on countless cases, including very high-profile murders and rapes.

The classic moral stories have been used extensively to teach children about the consequences of lying and the virtue of honesty. Despite their widespread use, there is no evidence whether these stories actually promote honesty in children. This study compared the effectiveness of four classic moral stories in promoting honesty in 3- to 7-year-olds. Surprisingly, the stories of “Pinocchio” and “The Boy Who Cried Wolf” failed to reduce lying in children. In contrast, the apocryphal story of “George Washington and the Cherry Tree” significantly increased truth telling. Further results suggest that the reason for the difference in honesty-promoting effectiveness between the “George Washington” story and the other stories was that the former emphasizes the positive consequences of honesty, whereas the latter focus on the negative consequences of dishonesty. When the “George Washington” story was altered to focus on the negative consequences of dishonesty, it too failed to promote honesty in children.

Abstract

It has been commonplace in the deception literature to assert the pervasive nature of deception in communication practices. Previous studies of lie prevalence find that lying is unusual compared to honest communication. Recent research, and reanalysis of previous studies reporting the frequency of lies, shows that most people are honest most of the time and the majority of lies are told by a few prolific liars. The current article reports a statistical method for distinguishing prolific liars from everyday liars and provides a test of the few prolific liars finding by examining lying behavior in the United Kingdom. Participants (N = 2,980) were surveyed and asked to report on how often they told both little white lies and big important lies. Not surprisingly, white lies were more common than big lies. Results support and refine previous findings about the distinction between everyday and prolific liars, and implications for theory are discussed.

Are Liars Ethical?

We tend to think of lying as a vice and honesty as a virtue. For hundreds of years, theologians and philosophers have suggested that lying is wrong. For example, almost six hundred years ago, St. Augustine stated, “To me…it seems certain that every lie is a sin.” The prohibition of lying is deeply ingrained in most major religions and the presumption that lying is wrong leads scholars, parents, and leaders to broadly condemn lying.

Despite the characterization of lying as unethical, most people don’t completely avoid lying. Sometimes we lie for selfish reasons, but quite often, we lie to help and protect others. We tell prosocial lies.

Countless studies have subsequently shown that we find it similarly difficult to resist social pressure from peers, friends and colleagues. Our decisions regarding everything from whether to turn the lights off when we leave a room to whether to call in sick to take a day off from work are affected by the actions and opinions of our neighbors and colleagues.

But what about those times when we are the ones trying to get someone to act unethically? Do we realize how much power we wield with a simple request, suggestion or dare? New research by my students and me suggests that we don’t.

Abstract

We examined the psychology of “instigators,” people who surround an unethical act and influence the wrongdoer (the “actor”) without directly committing the act themselves. In four studies, we found that instigators of unethical acts underestimated their influence over actors. In Studies 1 and 2, university students enlisted other students to commit a “white lie” (Study 1) or commit a small act of vandalism (Study 2) after making predictions about how easy it would be to get their fellow students to do so. In Studies 3 and 4, online samples of participants responded to hypothetical vignettes, for example, about buying children alcohol and taking office supplies home for personal use. In all four studies, instigators failed to recognize the social pressure they levied on actors through simple unethical suggestions, that is, the discomfort actors would experience by making a decision that was inconsistent with the instigator’s suggestion.

The Morning Morality Effect: The Influence of Time of Day on Unethical Behavior.

Abstract

Are people more moral in the morning than in the afternoon? We propose that the normal, unremarkable experiences associated with everyday living can deplete one's capacity to resist moral temptations. In a series of four experiments, both undergraduate students and a sample of U.S. adults engaged in less unethical behavior (e.g., less lying and cheating) on tasks performed in the morning than on the same tasks performed in the afternoon. This morning morality effect was mediated by decreases in moral awareness and self-control in the afternoon. Furthermore, the effect of time of day on unethical behavior was found to be stronger for people with a lower propensity to morally disengage. These findings highlight a simple yet pervasive factor (i.e., the time of day) that has important implications for moral behavior.

“There is still a culture among athletes,” the report said, “that resists both the self-reporting of concussions and compliance with appropriate concussion management plans.”

Dan Ariely tells truth about dishonesty, being irrational

Behavioral economist Dan Ariely says it's human to act irrationally, that most people lie, but that we can trust each other.

Most of us would rather not think of ourselves as irrational or dishonest. But in the books "Predictably Irrational" and "The (Honest) Truth About Dishonesty," Dan Ariely, a behavioral economist at Duke University, makes the case that we're all probably both. And what's more, he says, that's not entirely bad.

Does everyone behave irrationally sometimes?

Absolutely yes. Irrationality is not about stupidity. It's about being human. Actually it's about both. Sometimes we behave irrationally because we don't think, or we don't think long-term. But other times it's because we're human, because we're kind and generous and not selfish. So we're all irrational from time to time, and occasionally it's a good thing. How often we do it is hard to say. But consider texting and driving. If you text only 10% of the time that you drive, or even 1%, is that a lot or a little? The trouble is, however rarely you do it, the danger is just tremendous when you do.
