New York City’s new sex work policy isn’t only about changing morals

Sexual morality from the early modern period into recent decades tended to condemn the people — especially women — who accepted money in exchange for sexual services, depicting them as morally corrupt. Those who paid for sex — especially men — were often let off the hook by the same (hypocritical) standard. In this now out-moded worldview, taking money for sex amounted transformed a woman’s social status, while paying for sex had little or no effect on a man’s.

Today, we are increasingly willing to acknowledge that people who accept money for sex may often have had little or no choice in the decision. We recognize the realities of trafficking and substance dependence. We’re more aware of power disparities based on sex, race, gender identity and income. It has come to seem primitive to blame those who sell sex rather than those who purchase it.

To be sure, Manhattan — like Baltimore and Philadelphia, which have adopted similar policies — has not adopted the view promoted by some activists, namely that we should take morality out of the equation altogether and simply legalize and regulate all forms of sex work. The association between sex and morals remains as strong as ever in the new policy. But the moral calculus has changed.

On its own, however, this change in beliefs probably would not have sufficed to bring about a policy change. For that, what was required was a major reduction in the geographical prominence of sex work in Manhattan. Long-time residents of the island know this story well. As late as the 1980s, sex work, including prostitution, played a major role in the economy of the extended Times Square area. (The short-lived HBO series "The Deuce" sought to capture the atmosphere of this urban phenomenon in its late heyday.)

Over time, aggressive policing coupled with rezoning and extensive development moved sex work out of midtown. As Manhattan grew ever wealthier in the 1980s, and property values rose, sex work was also pushed out of other neighborhoods, like the Meatpacking District. Eventually, sex work in Manhattan reached the point where it is today: peripheral and relatively invisible rather than openly flourishing in particular neighborhoods.

State Medical Board Recommendations for Stronger Approaches to Sexual Misconduct by Physicians

The Federation of State Medical Boards (FSMB) recently engaged with its member boards and investigators, trauma experts, physicians, resident physicians, medical students, survivors of physician abuse, and the public to critically review practices related to the handling of reports of sexual misconduct (including harassment and abuse) toward patients by physicians. The review was undertaken as part of a core responsibility of boards to protect the public and motivated by concerning reports of unacceptable behavior by physicians. Specific recommendations from the review were adopted by the FSMB’s House of Delegates on May 2, 2020, and are highlighted in this Viewpoint.

Sexual misconduct by physicians exists along a spectrum of severity that may begin with “grooming” behaviors and end with sexual assault. Behaviors at any point on this spectrum should be of concern because unreported minor violations (including sexually suggestive comments or inappropriate physical contact) may lead to greater misconduct. In 2018, the National Academies of Science, Engineering, and Medicine identified sexual harassment as an important problem in scientific communities and medicine, finding that greater than 50% of women faculty and staff and 20% to 50% of women students reportedly have encountered or experienced sexually harassing conduct in academia. Data from state medical boards indicate that 251 disciplinary actions were taken against physicians in 2019 for “sexual misconduct” violations (Table). The actual number may be higher because boards often use a variety of terms, including unprofessional conduct, physician-patient boundary issues, or moral unfitness, to describe such actions. The FSMB has begun a project to encourage boards to align their categorization of all disciplinary actions to better understand the scope of misconduct.

Doctors Dating Patients: Love, Actually?

Not surprisingly, those who have seen such relationships end in messy, contentious divorces or who know stories of punitive actions are stridently opposed to the idea. "Never! Grounds for losing your license"; "it could only result in trouble"; "better to keep this absolute"; "you're asking for a horror story," wrote four male physicians.

Although doctor-patient romances don't frequently come to the attention of medical boards or courts until they have soured, even "happy ending" relationships may come at a cost. For example, in 2017, the Iowa Board of Medicine fined an orthopedic surgeon $5000 and ordered him to complete a professional boundaries program because he became involved with a patient while or soon after providing care, despite the fact that the couple had subsequently married.

Ethics aside, "this is a very dangerous situation, socially and professionally," writes a male physician in Pennsylvania. A New York physician agreed: "Many of my colleagues marry their patients, even after they do surgery on them. It's a sticky situation."

Doctors' Attitudes Are Shifting

The American Medical Association clearly states that sexual contact that is concurrent with the doctor/patient relationship constitutes sexual misconduct and that even a romance with a former patient "may be unduly influenced by the previous physician-patient relationship."

Although doctors' attitudes on the subject are evolving, that's not to say they suddenly believe they can start asking their patients out to dinner. Very few doctors (2%) condone romantic relationships with existing patients — a percentage that has remained largely unchanged over the past 10 years. Instead, physicians are taking a more nuanced approach to the issue.

Why Sex? Biologists Find New Explanations.

The immediate benefit of sex for the algae is that they form resistant diploid spores that can outlast a bad environment. When better conditions return, the algal cells return to their haploid state through meiosis. But as Nedelcu and her colleagues point out, the process of meiosis also offers unique opportunities for genomic improvement that go beyond diversity.

Like all multicellular organisms, these algae have ways of healing small breaks or errors in their DNA. But if the damage is bad enough, those mechanisms struggle to accurately repair it. In those cases, having a second copy of that strand of DNA to use as a template for the repairs can be a lifesaver. “That’s basically what most organisms have by being diploid,” Nedelcu explained.

Such indirect benefits may extend far beyond meiosis. “Sex also refers to copulation and sexual behaviors,” McDonough said. Researchers studying everything from crickets to mice are starting to see that having sex can have all sorts of unexpected upsides.

Unexpected, that is, because it’s generally assumed not only that sex is inefficient compared to asexual reproduction, but that it imposes an energy burden on the individuals involved. Producing eggs or sperm, finding a mate, the act of mating — all of it takes energy and resources. Consequently, there’s a trade-off between reproduction and other things an organism might do to survive longer, such as growing bigger or bolstering its immune system.

Of course, those consequences go both ways: Cultural beliefs and views on sex influence how we go about studying and interpreting the results from research on other organisms. Our biases regarding sexual activity — like which kinds are or aren’t “normal” or proper — “have essentially affected what it is that we’ve deemed important to study in animals,” Worthington said.

McDonough agrees that our preconceptions of what sex should look like and the reasons why an individual should or shouldn’t have it have biased our understanding of animal behavior. They point to the research on same-sex behaviors in animals as a prime example of this. McDonough and their colleagues noticed that the scientific discourse surrounding same-sex behaviors involves a lot of weak or baseless assumptions — for example, that engaging in sexual acts is inherently costly, so same-sex sexual interactions must provide some overwhelming benefit, such as a large increase in lifetime reproductive output, for the behavior to arise and stick around through natural selection. But “in many situations, it isn’t costly, and it may have some kind of benefit that we don’t understand,” McDonough said.

Friends, Lovers or Nothing: Men and Women Differ in Their Perceptions of Sex Robots and Platonic Love Robots

Abstract

Physical and emotional intimacy between humans and robots may become commonplace over the next decades, as technology improves at a rapid rate. This development provides new questions pertaining to how people perceive robots designed for different kinds of intimacy, both as companions and potentially as competitors. We performed a randomized experiment where participants read of either a robot that could only perform sexual acts, or only engage in non-sexual platonic love relationships. The results of the current study show that females have less positive views of robots, and especially of sex robots, compared to men. Contrary to the expectation rooted in evolutionary psychology, females expected to feel more jealousy if their partner got a sex robot, rather than a platonic love robot. The results further suggests that people project their own feelings about robots onto their partner, erroneously expecting their partner to react as they would to the thought of ones’ partner having a robot.

From the Discussion

The results of the analysis confirms previous findings that males are more positive toward the advent of robots than females (Scheutz and Arnold, 2016). Females who had read about the sex robot reported particularly elevated levels of jealousy, less favorable attitudes, more dislike and more predicted partner’s dislike. This pattern was not found in the male sample, whose feelings were largely unaffected by the type of robot they were made to envision.

One possible explanation for the gender difference could be a combination of differences in how males and females frame the concept of human-robot sexual relations, as well as different attitudes toward masturbation and the use of artificial stimulants for masturbatory purposes.

You Are Already Having Sex With Robots

Carnegie Mellon roboticist Hans Moravec has written about emotions as devices for channeling behavior in helpful ways—for example, sexuality prompting procreation. He concluded that artificial intelligences, in seeking to please humanity, are likely to be highly emotional. By this definition, if you encoded an artificial intelligence with the need to please humanity sexually, their urgency to follow their programming constitutes sexual feelings. Feelings as real and valid as our own. Feelings that lead to the thing that feelings, probably, evolved to lead to: sex. One gets the sense that, for some digisexual people, removing the squishiness of the in-between stuff—the jealousy and hurt and betrayal and exploitation—improves their sexual enjoyment. No complications. The robot as ultimate partner. An outcome of evolution.

So the sexbotcalypse will come. It's not scary, it's just weird, and it's being motivated by millennia-old bad habits. Laziness, yes, but also something else. “I don’t see anything that suggests we’re going to buck stereotypes,” says Charles Ess, who studies virtue ethics and social robots at the University of Oslo. “People aren’t doing this out of the goodness of their hearts. They’re doing this to make money.”

Technologizing sexual relationships will also fill one of the last blank spots in tech’s knowledge of (ad-targetable) human habits. Brianna Rader—founder of Juicebox, progenitor of Slutbot—has spoken about how difficult it is to do market research on sex. If having sex with robots or other forms of sex tech becomes commonplace, it wouldn’t be difficult anymore. “We have an interesting relationship with privacy in the US,” Kaufman says. “We’re willing to trade a lot of our privacy and information away for pleasures less complicated than an intimate relationship.”

It Loves Me, It Loves Me Not Is It Morally Problematic to Design Sex Robots that Appear to Love Their Owners?

Abstract

Drawing on insights from robotics, psychology, and human-computer interaction, developers of sex robots are currently aiming to create emotional bonds of attachment and even love between human users and their products. This is done by creating robots that can exhibit a range of facial expressions, that are made with human-like artificial skin, and that possess a rich vocabulary with many conversational possibilities. In light of the human tendency to anthropomorphize artifacts, we can expect that designers will have some success and that this will lead to the attribution of mental states to the robot that the robot does not actually have, as well as the inducement of significant emotional responses in the user. This raises the question of whether it might be ethically problematic to try to develop robots that appear to love their users. We discuss three possible ethical concerns about this aim: first, that designers may be taking advantage of users’ emotional vulnerability; second, that users may be deceived; and, third, that relationships with robots may block off the possibility of more meaningful relationships with other humans. We argue that developers should attend to the ethical constraints suggested by these concerns in their development of increasingly humanoid sex robots. We discuss two different ways in which they might do so.

Can a Woman Rape a Man and Why Does It Matter?

Abstract

Under current UK legislation, only a man can commit rape. This paper argues that this is an unjustified double standard that reinforces problematic gendered stereotypes about male and female sexuality. I first reject three potential justifications for making penile penetration a condition of rape: (1) it is physically impossible for a woman to rape a man; (2) it is a more serious offence to forcibly penetrate someone than to force them to penetrate you; (3) rape is a gendered crime. I argue that, as these justifications fail, a woman having sex with a man without his consent ought to be considered rape. I then explain some further reasons that this matters. I argue that, not only is it unjust, it is also both a cause and a consequence of harmful stereotypes and prejudices about male and female sexuality: (1) men are ‘always up for sex’; (2) women’s sexual purity is more important than men’s; (3) sex is something men do to women. Therefore, I suggest that, if rape law were made gender neutral, these stereotypes would be undermined and this might make some (albeit small) difference to the problematic ways that sexual relations are sometimes viewed between men and women more generally.

3 Final Thoughts on Gender and Rape

The belief that a woman cannot rape a man, therefore, might be both a cause and a consequence of these kinds of harmful gendered stereotypical beliefs:

(a) Sex is something that men do to women.
(b) This is, in part, because men have an uncontrollable desire for sex; women are less bothered about sex.
(c) Due to men’s uncontrollable desire for sex, women must moderate their behaviour so that they don’t tempt men to rape them.
(d) Men are sexually aggressive/dominant (or should be); women are not  (or shouldn’t be).
(e) A woman’s worth is determined, in part, by her sexual purity; a man’s worth is determined, in part, by his sexual prowess.

Of course, these beliefs are outdated, and not held by all people. However, they are pervasive and we do see remnants of them in parts of Western society and in some non‑Western cultures.

However, I think that it is the middle-class consciousness of liberal feminism that excluded sex work from its platform. After all, wealthier women didn’t need to do sex work as such; they operated within the state-sanctioned transactional boundaries of marriage. The dissatisfaction of the 20th-century housewife was codified as a struggle for liberty and independence as an addition to subsidised material existence, making a feminist discourse on work less about what one has to do, and more about what one wants to do. A distinction within women’s work emerged: if you don’t enjoy having sex with your husband, it’s just a problem with the marriage. If you don’t enjoy sex with a client, it’s because you can’t consent to your own exploitation. It is a binary view of sex and consent, work and not-work, when the reality is somewhat murkier. It is a stubborn blindness to the complexity of human relations, and maybe of human psychology itself, descending from the viscera-obsessed, radical absolutisms of Andrea Dworkin.

The housewife who married for money and then fakes orgasms, the single mother who has sex with a man she doesn’t really like because he’s offering her some respite: where are the delineations between consent and exploitation, sex and duty? The first time I traded sex for material gain, I had some choices, but they were limited. I chose to be exploited by the man with the resources I needed, choosing his house over homelessness. Lolita was a child, and she was exploited, but she was also conscious of the function of her body in a patriarchal economy. Philosophically speaking, most of us do indeed consent to our own exploitation.

Ethics board fines former Pa. judge for texts, sex with defendant's girlfriend

Pennsylvania's judicial ethics board fined a since-retired district judge $5,000 this week for having sex with the girlfriend of a defendant, sending her salacious texts and letting his own lawyer practice before him without telling the other parties.

The Court of Judicial Discipline fined former Bradford County District Judge Michael G. Shaw and issued a severe reprimand, saying he had appeared to be genuinely contrite.

Shaw spent 24 years as district judge in Sayre, but did not run for re-election in 2017, as he was being investigated.

The court says Shaw, who was not charged criminally, appeared to be genuinely remorseful for his conduct. His lawyer in the proceedings, William Hebe, did not return a phone message Friday.

Shaw is a former police officer and is not a lawyer. Pennsylvania magisterial district judges, who are elected, do not have to be licensed lawyers. District judges set bail and conduct preliminary hearings for serious crimes, and handle minor offenses and lower-level civil matters.

Court findings say Shaw was supervising treatment court in 2014 when a repeat DUI defendant he knew enrolled in the court program. Shaw had worked for the man's father years before.

The man's girlfriend subsequently told Shaw on Facebook that she was breaking up with the man, leading to a series of messages that became sexual in nature.

The Brave New World of Sex Robots

But as the technology develops apace, so are a host of other issues, including political and social ones (Why such emphasis on feminine bots rather than male? Do sexbots really need a “gender” at all?); philosophical and ethical ones (Is sex with a robot really “sex”? What if the robots are sentient?); and legal ones (Does sex with a robot count as cheating on your human partner?)

Many of these concerns overlap with present controversies regarding AI in general, but in this realm, tied so closely with the most profound manifestations of human intimacy, they feel more personal and controversial. Perhaps as a result, Devlin has a self-admitted tendency at times to slip into somewhat heavy-handed feminist polemics, which can overshadow or obscure possible alternative interpretations to some questions — it’s arguable whether the “Blade Runner” films have “a woman problem,” for example, or whether the prevalence of sexbots with idealized and identifiably feminine aesthetics is solely a result of “male objectification.”

Informed by her background as a computer scientist, Devlin provides excellent nuts-and-bolts technical explanations of the fundamentals of machine learning, neural networks, and language processing that provide the necessary foundation for her explorations of the subject, whose sometimes sensitive nature is eased by her sly sense of humor.

We're Teaching Consent All Wrong

Instead, researchers and educators offer an alternative: Teach consent as a life skill—not just a sex skill—beginning in early childhood, and begin discussing consent and communication in the context of relationships by 5th or 6th grades, before kids start seriously thinking about sex. (Think that's too young? In yet another study, the CDC found 8 in 10 teenagers didn't get sex education until after they'd already had sex.)

Educators and parents often balk at discussing strategies for and examples of consent because "they incorrectly believe that if you teach consent, students will become more sexually active," said Mike Domitrz, founder of the Date Safe Project, a Milwaukee-based sexual-assault prevention program that focuses on consent education and bystander interventions. "It's a myth. Students of both genders are pretty consistent that a lot of the sexual activity that is going on is occurring under pressure."

Studies suggest young women are more likely to judge consent on verbal communication and young men relied more on nonverbal cues, though both groups said nonverbal signals are often misinterpreted. And teenagers can be particularly bad at making decisions about risky behavior, including sexual situations, while under social pressure. Brain studies have found adolescents are more likely to take risks and less likely to think about negative consequences when they are in emotionally arousing, or "hot," situations, and that bad decision-making tends to get even worse when they feel they are being judged by their friends.

Making understanding and negotiating consent a life skill gives children and adolescents ways to understand and respect both their own desires and those of other people. And it can help educators frame instruction about consent without sinking into the morass of long-running arguments and anxiety over gender roles, cultural values, and teen sexuality.

Serious Ethical Violations in Medicine: A Statistical and Ethical Analysis of 280 Cases in the United States From 2008–2016

Abstract

Serious ethical violations in medicine, such as sexual abuse, criminal prescribing of opioids, and unnecessary surgeries, directly harm patients and undermine trust in the profession of medicine. We review the literature on violations in medicine and present an analysis of 280 cases. Nearly all cases involved repeated instances (97%) of intentional wrongdoing (99%), by males (95%) in nonacademic medical settings (95%), with oversight problems (89%) and a selfish motive such as financial gain or sex (90%). More than half of cases involved a wrongdoer with a suspected personality disorder or substance use disorder (51%). Despite clear patterns, no factors provide readily observable red flags, making prevention difficult. Early identification and intervention in cases requires significant policy shifts that prioritize the safety of patients over physician interests in privacy, fair processes, and proportionate disciplinary actions. We explore a series of 10 questions regarding policy, oversight, discipline, and education options. Satisfactory answers to these questions will require input from diverse stakeholders to help society negotiate effective and ethically balanced solutions.

Sex talks

Communication is essential to ethical sex. Typically, our public discussions focus on only one narrow kind of communication: requests for sex followed by consent or refusal. But notice that we use language and communication in a wide variety of ways in negotiating sex. We flirt and rebuff, express curiosity and repulsion, and articulate fantasies. Ideally, we talk about what kind of sex we want to have, involving which activities, and what we like and don’t like. We settle whether or not we are going to have sex at all, and when we want to stop. We check in with one another and talk dirty to one another during sex. 

In this essay I explore the language of sexual negotiation. My specific interest is in what philosophers call the ‘pragmatics’ of speech. That is, I am less interested in what words mean than I am in how speaking can be understood as a kind of action that has a pragmatic effect on the world. Philosophers who specialise in what is known as ‘speech act theory’ focus on what an act of speaking accomplishes, as opposed to what its words mean. J L Austin developed this way of thinking about the different things that speech can do in his classic book, How To Do Things With Words (1962), and many philosophers of language have developed the idea since.

Should we care that the sex robots are coming?

There’s no evidence to suggest that human-human relationships will be damaged. Indeed, it may be a chance for people to experience feelings of love that they are otherwise denied, for any number of reasons. Whether or not that love is considered valid by society is a different matter. And while objectification is definitely an issue, it may be an avoidable one. Security and privacy breaches are a worry in any smart technologies, which puts a whole new spin on safe sex.

As for child sex robots – an abhorrent image – people have already been convicted for importing child-like sex dolls. But we shouldn’t shy from considering whether research might deem them useful in a clinical setting, such as testing rehabilitation success, as has been trialled with virtual reality.

While non-sexual care robots are already in use, it was only three months ago, that the race to produce the first commercially-available model was won by an lifeless sex doll with an animatronic head and an integrated AI chatbot called Harmony. She might look the part but she doesn’t move from the neck down. We are still a long way from Westworld.

Naturally, a niche market will be delighted at the prospect of bespoke robot pleasure to come. But many others are worried about the impact these machines will have on our own, human relationships. These concerns aren’t dispelled by the fact that the current form of the sex robot is a reductive, cartoonish stereotype of a woman: all big hair and bigger breasts.

When people have this idea of a sex robot, they think it’s going to look like a human being, it’s gonna walk around and say seductive things and so on. I think that’s actually the slowest-developing part of this whole nexus of sexual technology. It will come — we are going to have realistic sex robots. But there are a few technical hurdles to creating humanoid robots that are proving fairly stubborn. Making them walk is one of them. And if you use Siri or any of those others, you know that AI is proving sort of stubbornly resistant to becoming realistic.

But I think that when you look more broadly at what’s happening with sexual technology, virtual reality in general has just taken off. And it’s being used in conjunction with something called teledildonics, which is kind of an odd term. But all it means is actual devices that you hook up to yourself in various ways that sync with things that you see onscreen. It’s truly amazing what’s going on.

When you look at the ethical or philosophical considerations, — I think there’s two strands. One is the concerns people have, and two, which I think maybe doesn’t get as much attention, in the media at least, is the potential advantages.

The concerns have to do with the psychological impact. As you saw with those Apple shareholders [who asked Apple to help protect children from digital addiction], we’re seeing a lot of concern about the impact that technology is having on people’s lives right now. Many people feel that anytime you’re dealing with sexual technology, those sorts of negative impacts really become intensified — specifically, social isolation, people cutting themselves off from the world.

In Blade Runner 2049, the true significance of K’s relationship with Joi is ambiguous. It seems that they really care for each other, but this could be an illusion. She is, after all, programmed to serve his needs. The relationship is an inherently asymmetrical one. He owns and controls her; she would not survive without his good will. Furthermore, there is a third-party lurking in the background: she has been designed and created by a corporation, which no doubt records the data from her interactions, and updates her software from time to time.

This is a far cry from the philosophical ideal of love. Philosophers emphasise the need for mutual commitment in any meaningful relationship. It’s not enough for you to feel a strong, emotional attachment to another; they have to feel a similar attachment to you. Robots might be able to perform love, saying and doing all the right things, but performance is insufficient.

The Sex Robots Are Coming – an intriguing report into the mind-boggling world of adult dolls

Sex robots: where do you start? In a Californian laboratory, obviously, where a hot next generation of Frankenstein’s monster is being conjured into existence. The latest prototype is a buxom object called Harmony who talks dirty in (for some reason) a Scottish accent. We made her acquaintance in The Sex Robots Are Coming (Channel 4) which, for reasons one needn’t explain, was not necessarily an accurate title.

Sexbots are the next big thing in Artificial Intelligence. We met James, a gentle lantern-jawed man from Atlanta whose current harem of life-size dolls uncomplainingly submit to a regime of two to four couplings a week in a host of positions. The only drawback, it seemed, was they couldn’t tell him they love him like a sexbot would.

These things were being fixed in the lab, which looked like a charnel house of serried butts and decapitated manikins. The task of chief engineer Matt was to turn all this plasticated form into a set of mechanised emotions. He was developing a range of personalities, he said, though the array of demeaning stereotypes didn’t seem to include the harridan or the hysteric.

Foucault’s work shows that disciplinary power was just one of many forms that power has come to take over the past few hundred years. Disciplinary anatomo-politics persists alongside sovereign power as well as the power of bio-politics. In his next book, The History of Sexuality, Foucault argued that bio-politics helps us to understand how garish sexual exuberance persists in a culture that regularly tells itself that its true sexuality is being repressed. Bio-power does not forbid sexuality, but rather regulates it in the maximal interests of very particular conceptions of reproduction, family and health. It was a bio-power wielded by psychiatrists and doctors that, in the 19th century, turned homosexuality into a ‘perversion’ because of its failure to focus sexual activity around the healthy reproductive family. It would have been unlikely, if not impossible, to achieve this by sovereign acts of direct physical coercion. Much more effective were the armies of medical men who helped to straighten out their patients for their own supposed self-interest.

Other forms of power also persist in our midst. Some regard the power of data – that is the info-power of social media, data analytics and ceaseless algorithmic assessment – as the most significant kind of power that has emerged since Foucault’s death in 1984.
